These Terms & Conditions (“Terms”) govern your use of DinnerDiary (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 13 years old (or the minimum age in your country) to use the Service. You are responsible for your account, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorised use.
2. Acceptable use
You agree not to:
- Break the law or infringe others’ rights.
- Upload unlawful, harmful, hateful, or infringing content, or content you don’t have the right to share.
- Scrape, reverse-engineer, overload, or interfere with the Service or its security.
- Impersonate others or misrepresent your affiliation.
- Use the Service to send spam or harvest others’ data.
We may suspend or terminate accounts that violate these Terms or put the Service or other users at risk.
3. Your content
You retain ownership of the lists, places, ratings, notes, and photos you add (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display Your Content solely to operate and improve the Service. If you make a list or profile public, you grant others the ability to view and share it. You are responsible for Your Content and confirm you have the rights to it.
4. Subscriptions & billing
- Free plan: up to 5 lists (1 public), 200 places, 20 friends, and 3 photo uploads per month.
- Plus: $0.99/month or $9.99/year, with a one-month free trial for new subscribers. Plus unlocks unlimited lists, places, and public lists; unlimited photo uploads; the activity feed and taste match; and Google Maps and social-link imports.
- Billing: payments are handled by Polar, our Merchant of Record, who acts as the seller of record and manages taxes. Subscriptions renew automatically at the then-current price until cancelled.
- Free trial: if you cancel before the trial ends, you will not be charged. Otherwise your paid subscription begins when the trial ends.
- Cancellation: you can cancel anytime from Settings → Manage subscription. You keep Plus access until the end of the current billing period; we do not provide prorated refunds for partial periods except where required by law or Polar’s policies.
- Price changes: we may change prices with notice; changes apply to renewals after the notice period.
5. Intellectual property
The Service, including its software, design, logos, and content we provide, is owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
6. Third-party services
The Service integrates third parties such as Polar, Mapbox, Google, and AWS. Your use of those features may be subject to their terms, and we are not responsible for third-party services or content.
7. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. Place data, ratings, and recommendations may be inaccurate or incomplete.
8. Limitation of liability
To the maximum extent permitted by law, DinnerDiary and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with an updated date; continued use of the Service after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules. Nothing here limits any non-waivable consumer rights you may have.
