Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of DinnerDiary (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must meet the minimum age required in your region to use the Service. You are responsible for your account and for keeping your login credentials secure.

2. Acceptable use

You agree not to:

• Break the law or violate others’ rights.
• Upload illegal, abusive, hateful, misleading, or infringing content.
• Abuse, overload, scrape, reverse-engineer, or disrupt the Service.
• Impersonate other people or organizations.
• Use the Service for spam, fraud, or harassment.

We may restrict or suspend accounts that violate these Terms.

3. Your content

You keep ownership of content you create in DinnerDiary. You give us permission to host and process that content to operate the Service.

4. Subscriptions & billing

• Free plan: up to 5 lists (1 public), 200 places, 20 friends, and 3 photo uploads per month.
• Plus: $0.99/month or $9.99/year, with a one-month free trial for new subscribers. Plus unlocks unlimited lists, places, and public lists; unlimited photo uploads; the activity feed and taste match; and Google Maps and social-link imports.
• Billing: payments are handled by Polar, our Merchant of Record, who acts as the seller of record and manages taxes. Subscriptions bought in the iOS or Android app are billed by Apple or Google under their terms. Subscriptions renew automatically at the then-current price until cancelled.
• Free trial: if you cancel before the trial ends, you will not be charged. Otherwise your paid subscription begins when the trial ends.
• Cancellation: you can cancel anytime from Settings → Manage subscription on the web, or in your App Store or Google Play subscription settings for in-app purchases. You keep Plus access until the end of the current billing period; we do not provide prorated refunds for partial periods except where required by law or Polar’s policies.
• Price changes: we may change prices with notice; changes apply to renewals after the notice period.

5. Comments and community content

Public lists can receive comments and community ratings from signed-in users. List owners can moderate comments on their own lists, including removing content that is abusive, off-topic, or violates these Terms.

Prohibited content includes:

• Harassment, hate speech, threats, or doxxing.
• Spam, scams, or coordinated manipulation.
• Sexually explicit or violent content intended to harm.
• Copyright-infringing material you do not have rights to use.

We have zero tolerance for objectionable content and abusive users. You can report comments, lists, profiles, photos, and AI answers from the app, and block other users. We review reports within 24 hours, remove content that violates these Terms, and suspend or remove accounts that post it.

6. Intellectual property

The Service and its original software, designs, and branding are owned by DinnerDiary or its licensors.

7. Third-party services

The Service relies on third-party providers such as Polar, Vercel, Railway, Google, and push notification services. Their products are governed by their own terms.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. Place data, ratings, and recommendations may be inaccurate or incomplete.

9. Limitation of liability

To the maximum extent permitted by law, DinnerDiary and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with an updated date; continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules. Nothing here limits any non-waivable consumer rights you may have.
